Legal Question in Credit and Debt Law in California

two people are on a auto loan then they split up, on party keeps the vehicle and has made 24 payments, got behind by 1 payment but not 30 days delinquent. The second party decides he does not want to be on the contract anymore and goes to the party who has posession of the vehicles apartment complex and takes the vehicle and says unless the first party can get financed in her own name he is going to sell the vehicle.

The question is, can he do that?

Can he decide he does not want to be on contract anymore? A: He can decide anything he wants, i.e., he can decide he wants to marry Angelina Jolie, good luck.

Can he take possession of the vehcle, legally? A: Yes

Can he say unless 1st party gets financed he is going to sell the vehicle? A: Yes, he can say whatever he wants, and he can sell the vehicle to any fool who is willing to buy a vehiclce without a pink slip, you would still be a registered co-owner of the vehicle with the new owner.
