Legal Question in Credit and Debt Law in California

Personal Debt Repayment - With a signed contract

My ex-boyfriend used to live with me, and during that period of time he borrowed over $10,000 to buy a car and to pay for back rent that he owed me for living in my house. He was supposed to pay for this debt over a 6 month period of time, but his payments were always late and were not always in full. Also, I took the pink slip for the car as collateral to ensure that his payments would come, but that didn't seem to affect him. A few months ago, I made him sign a contract stating the exact remaining balance as well as the due dates of each payment. He currently owes me about $7500, with about $6000 of it due now, according to the contract. I have tried repeatedly to contact him with no avail. Since he did sign a contract with me, does that mean I have a legal right to the money he owes me? And is there a way to settle this matter without going to court or is that the only solution?

You would have to go to court. Whether you could collect is another story. If you know where he banks and works, then you're 85% of the way toward collecting. Good luck.
