Legal Question in Credit and Debt Law in California

Personal Loan Agreement

I loaned a large some of money to my ex-boyfriend over 10 years ago. We had a signed agreement of which I still possess. About 2 1/2 years ago, he gave me a small payment because I think he felt guilty all these years. At any rate, I have asked him that's no acceptable that he hasn't paid me back. We have been trying to figure out a good method of repayment. If we don't come up with a payment agreement, what are my legal rights? Can I take him to court with this signed document and get my money? Please advise.

Re: Personal Loan Agreement

You may be able to take him to court. He may be able to argue that the statute of limitations has expired. He may also argue that the terms of the agreement are such that it cannot be determined when he has to pay you back. It would depend on what your agreement looks like. If it is a large enough amount, you may want to have an attorney review it and provide you with an opinion.

Re: Personal Loan Agreement

You had better file suit immediately as there is already a statute of limitations issue. Contact me directly.
