plantiff is an unclaimed property service

An unclaimed property service is filing a lawsuit against me claiming that I didn't provide them information in a timely manner. I have only signed one asset recovery agreemtn form from a postal mail they sent me a few years ago. Then, they never contacted me since. I was concerned that I signed a fraud angency advertisement mail. Thus, I tried to call the office. no one answered. I since then moved. They have never contacted me since. I claimed my unclaimed propery myself this year. All of a sudden, this agency starts to harrase me for not paying them the service fee. They claimed that I didn't provide them paper work in a timely manner. What should I do? Can I sue them for all their harrasement and invade of privacy (how did they find out about my unclaimed property to begin with)? What type of attoney can I consult?

First of all, how much is involved? Will this be a small claims action, or something in Superior Court. If small claims, you won't need an attorney, and you might consider a counter suit for the maximum ($5000).

If they needed additional information, they need to ask for it. Unclaimed property in California goes to the State of California for holding. The information can be found on the website for the State Controller. It is not hard to find.

These guys might just get people to sign "contracts" and then let the "client" do the work, and harrass them later.

You might contact the Controller's office to see if they know anything about this company.
