Legal Question in Credit and Debt Law in California

Prior debts

My previous spouse ran up the debts to where I can not pay. He is filing bankruptcy. Am I liable for the total amount owed? Is my current husband finacially liable for the debts incurred prior to my current marriage. If I file bankruptcy, is my present husband exempt? Please let me know.

You should have someone review your situation in detail but i will try to give some general answers. If the debts are joint debts from when you are married before you are likely still on the hook for them but the new husband is not. you can file a BK on your own without your new husband joining in.
