Legal Question in Credit and Debt Law in California

private party car contract

I am taking this person to court due to being 5 months behind on car payments. However, after trying to repo the car...he now has the car in hiding. Due to there being no insurance on the car and my case is not for another month, are their any other ways to protect myself (alert the local police or give up the interest in the car..guessing)..thanks.

If you are still on title, you need to buy your own insurance policy. If you are not on title, then all you can do is sue for money. If you have a lawsuit pending, you can serve the defendant with a subpoena duces tecum requiring him to produce the car at the time of trial. If he does not show up, you can have the court issue a warrant for his arrest and have him put in jail until he reveals the location of the car.
