proper response form for a summons

I'm required to submit a written response to summons, sum-100, and don't know what form to use.

If it's for a debt collection case, use http://www.courtinfo.ca.gov/forms/fillable/pldc010.pdf. If for an accident-type case, you'd want to use the answer on that website for injury/motor vehicle, etc. Often an attorney can assist you with resolving the matter short of trial.

The proper response could be one of a few things:

1. As Mr. Cohen suggests, you may need to file an answer.

2. You may need to file a demurrer.

3. You may have waited too long and need to file a motion to set aside a judgment, if they have one.

Each situation is different. You should consult with an attorney about which form should be filed in YOUR situation.
