Legal Question in Credit and Debt Law in California
I purchased several vending machines that were in operation at 10 different locations for $32,500 total. As I serviced them for couple of months, I was very upset at the seller because the sales was not even close to what he promised it will be. He promised to replace the locations if the sales do not meet what he promised. When I asked for replacement of locations, he refused to do so. So I asked him for full refund of $32,500, he said he'll sell them to other people and get me the refund. I prepared a promissory note in the amount of $32,500 to be paid in full by July 1, 2010. Today is September 10, 2010, and he is avoiding my calls, not replying to voice messages and emails. What should I do to get my money back? He has three homes and about 50-100 locations of vending machines.

If he signed the note, it's a simple collection action on the note. Sue.
