Legal Question in Credit and Debt Law in California

Question #1 Can a Bank credit card company (Visa), sue a wife and the husband in California,

A. if the wife obtained a credit card (Visa) in her (the wife�s) name,

B. and the husband did not sign the application for the (Visa) credit

C. and his name was not mentioned on the application

D. and he (the husband) was not a signer on the wife�s (Visa) credit card

E. and the wife owes $12,000 and she has stopped paying because of the 30% interest rate the bank is charging.

Question #2 Can a Bank (Visa) credit card company,

A. take the amount the wife owes the Bank, $12,000 on her (Visa) credit card,

B. from the husbands business account,

C. if the wife is a signer on the husbands business account?

Question #3 Can a Bank credit card company,

A. deposit to the husband�s (Master) card the amount his wife owes $12,000,

B. then deduct that amount from the husbands ( Master) card, just because the husbands (Master) card has a limit of up to $25,000,

C. and the husband did not authorize or ask for the amount $12,000.
