''Real Property''

Is trying to collect car payments from a friend considered ''Real Property''? Where do I file if the amount is over $1,000? What forms do I use?

No, it is not real property. real property means real estate (land).

use small claims court for anything up to $5,000. you can get the forms from the court clerk.

No; money that someone owes you is considered personal property. Real property is generally defined as land, and any buildings erected on the land.

You can file a small claims lawsuit (for amounts under $5,000.00) by contacting your local small claims court clerk, who will provide you with the forms you need to fill out. Many courts also have "small claims advisors" who can assist you in filling the forms out.
