Legal Question in Credit and Debt Law in California
I received a Civil Summons for a balance I owe on a credit card from about 5 years ago. I stopped using the card when the balance was zero however, it kept accruing interest and late fees every month. The plantiff is Midland Funding, who I believe is a junk debt buyer. Also, the credit card company is being sued for breaking the law in the way they encouraged and persudaed people to apply for their cards. I am a classmember in this law suit. What options do I have and how do I need to respond to the summons? Desperately seeking help!

You need to answer the complaint within 30 days of the date you were served with the summons and complaint or you will lose the case by default. No matter how evil that organization might be if you owe the money legally you have to pay it. The court will decide if you do owe the money. You need to see a lawyer to prepare your answer or at least someone who can help you if you do not know how to prepare a formal answer.
