Legal Question in Credit and Debt Law in California

Received a Summons

I have received a summons regarding a credit card debt. I am not familiar with the collection agency on the summons. What should I do? The file date was April 14 but I did not receive until May 7th if not later. What should I do? I want to make some payment arrangements.

Re: Received a Summons

Preferably you should not contact the CA until you have seen a lawyer, and do not talk to a CA, deal with them (if at all) only certified mail RRR. They may be trying to sue on a stale debt (if your last payment was due more than 4 years before the filing date, they filed too late); and/or the CA may not be able to prove up the debt in court. If either of these applies, see a lawyer. See generally creditboards.com or creditinfocenter.com .
