Legal Question in Credit and Debt Law in California

I recently found out that the cemetery removed my mothers headstone due to a balance due on the burial from 40 years ago. They want the balance, plus interest paid in full. Only then will they allow me to purchase and place another headstone.

There is no question in your post. I assume you are asking if they can do this? If that is your question, the answer can only be given after reviewing the documents related to the purchase and financing of the headstone. Further, if you pay off the balance owed, why would you have to buy another headstone - pressumably what you owe them includes the headstone that was placed when she was buried. Finally, the statute of limitations may have run on their ability to collect the debt. Contact the California Department of Consumer Affairs to see if what the cemetary did was legal.
