Legal Question in Credit and Debt Law in California
I recently got an incredibly high quote from our local Roto Rooter to repipe my home. Through the process, I allowed them to check our credit in case we needed to finance, but they did not get the job in the end, and no contract was ever signed.
A week later I received a *real* credit card with a limit for the amount of Roto Rooter's quote for the job. They not only took out a line of credit in my husbands name, they misspelled our name and we were never informed we would be getting the card. They also didn't finance it themselves through their company, they got it from Wells Fargo. After contacting them, they said to just "cut up the card" if I didn't want it, but that isn't the point.
Is it legal for them to send out for an actual credit card in our name, especially without any signed consent?

Of course not. They also committed a fraud on Wells Fargo. Report them to the corporate headquarters and Wells Fargo.
