Legal Question in Credit and Debt Law in California
Release from debt obligation?
I was hospiltalized last April, and was unconscious the whole visit. The hospital did not obtain my signature on any form, nor did they find anything wrong with me (stress). I was unemployed at the time, and filed an indigent form with the accounting department. They have been trying to collect on this $1500 bill for a year, but I was unable to repay. This month I sent in a check for 1% of the total, and wrote clearly on the face of the check "paid in full."
The hospital cashed the check, but sent me a new statement for the balance. Does acceptance of this check clear me of this debt?

Re: Release from debt obligation?
it depends on how they endorsed the check. if they just deposited the check you may be in the clear. if they endorsed it with a notice that they were reserving their rights then they can still collect the rest.
