Legal Question in Credit and Debt Law in California
remarriage, old debts
My son has never been married. He plans to marry his fiancee in 6 months. She is divorced with no children. They both live in Calif. She and her ex bought property in Wisc and that property went into foreclosure. Her name is on the purchase agreement. My son and fiancee plan on buying a house together. Question: After they marry, will my son be responsible for her debts? Can his checking account be attached and a lien be placed on their new home?

Re: remarriage, old debts
Your son will not be responsible. BUT, if they hold property (including real property and bank accounts) jointly, it is subject to levy. He might want to make an appointment with an attorney to create a plan to avoid such problems.
