Legal Question in Credit and Debt Law in California
Removal of a cosigner from my card
I removed him 2 years ago via phone, the acct was closed and statements came to me alone. We noticed him listed as joint 6 months ago on his credit report and requested the form for removal. After sending their form this May 18, they now deny removal and call us both liable. How doI procedd and sue because they have falsely placed him as a joint card holder which I never authorized?

Re: Removal of a cosigner from my card
If he signed the credit card agreement with you when you obtained the card, he would be jointly liable for the debt, even if the card is closed.
If he was merely an authorized user of the card and therefore not liable for the debt, then the debt should not be listed on his credit report. He may file a dispute with the three credit reporting agencies explaining this.
