Legal Question in Credit and Debt Law in California

Request to Enter Default

We received the following letter, but think the SOL has passed and we can prove it. However, we don't have much money for an attorney. What can we do on our own, and if we do have to go to court, can we fight this on our own?

''The enclosed Request to Enter Default has been sent tot he Court, along with documents necessary to have a judgement entered against you. Please call our office immediately should you wish to attempt a voluntary resolution to this matter.''

Re: Request to Enter Default

If you were sued past the SOL on a consumer debt matter, I'm very interested in the case. The Request to Enter Default should have been preceded by your receiving a lawsuit and your failing to respond to it. If you never received the lawsuit, then this also may be an unfair debt collection practice. Do not call the other attorney. Call me or some other attorney experienced in consumer debt collection matters and in whom you have confidence.
