Legal Question in Credit and Debt Law in California

How to respond to summons?

Summons served in my absence at work, received by my boss, original filed May 1, 2006 L.A. superior court, along with notice of case management conference filed same date as summons and scheduled for Oct. 17, 2006. How do I respond to this? Plaintiff is a local law firm, damages of $6894 for credit card debt plus 10% interest and attorney fees. I stopped paying due to my job changing to part time and medical issues/bills. Please advise.

Thank you.

Re: How to respond to summons?

The statute of limitations is generally four years from the time you made the last payment or promise to pay. Otherwise, you may well be toast unless your other debts are such that you could consider bankruptcy as an option. You respond to the lawsuit by filing an Answer, paying $180 to file it with the court, and having someone other than yourself serve the Answer on the plaintiff's law firm and then you would file the proof of service along with your Answer.
