Responding to a Summons

How do I respond to a summons and do I need a specific court form? I live in Tulare County California.

Also the summons was left in my garden when noone was home. Is this legal?

I found it a few days ago and called the court to find out when it was supposedly served. It was almost a month ago and now I have only until Monday to respond.

See http://www.courtinfo.ca.gov/forms/fillable/982135.pdf for a fillable answer form. You could also file a motion to quash because service was never effected. It would be worth your while to consult with an attorney so that all of your affirmative defenses may be pled and to strategize about whether the plaintiff can actually prove its case or whether a statute of limitation might have run.
