Legal Question in Credit and Debt Law in California

Response to Summons

I was sued by a collection agency and received a summons, sum-100. On what form do I file a response?

Can I make accord and settlement and, if so, with who: the collection agency or lawyer?

Re: Response to Summons

Sounds like you need an Answer to a Complaint. That is located here: http://courtinfo.ca.gov/forms/documents/pldc010.pdf

Was it an attorney or collection agency that filed the complaint? If it was passed on to an attorney, then that is who you will need to contact. If this is a Superior Court matter, I really suggest you talk to an attorney of your own and get their advice after you explain all the facts before you do anything.

Remember, you have 30 days from the date you were served to file your answer.

You can use the answer form at http://www.courtinfo.ca.gov/forms/fillable/pldc010.pdf

If there's time, try negotiating with the lawyer first.
