Legal Question in Credit and Debt Law in California

Am I responsible for credit card debt that was part of a divorce settlement?

Last July my husband left me and filed for divorce two days later. As part of the divorce, he agreed that I would keep the house (which he quit-claimed to me) and subsequent payment of $1600, and he would take the credit cards and the subsequent payments. He then filed for bankruptcy on all the credit cards, which were also in my name. I was not included on his bankruptcy, which was final before the divorce was final.

Now that the divorce is final, as of April 8th, 2004, the credit card companies are coming after me for payment. I was unemployed when my husband left, and am still unemployed. My only income is $644/month from social security which my 84-year-old invalid mother collects. My savings are gone, and I am having trouble finding work and paying the mortgage, because I must be home to take care of my mother.

Am I responsible for the credit cards, even though he took them as part of the divorce?

Yes, you are still responsible for the CC debt. People can't agree among themselves regarding joint liability to a lender. He, on the other hand, is probably still liable to you.
