Legal Question in Credit and Debt Law in California

What are my rights? What do I need to do?

I am being harrast by some nickle and dime attorney service for an assumed debt from an adult phone service company. When I called them to find out what the h--- they were talking about, I was told that an account was made to this phone service from phone number ###-####, which was my old phone number. But I still have no idea what he's talking about. I have never opened such an account. After a short discussion of telling him he's crazy, he hung up on me. After reading some of your Q/A's on your website I decided to call them again to ask a few questions. The person I spoke with was very condescending and ended up hanging up on me again.

The only information that I have gotten from them is the company name of the assumed debt I owe and that this happened back in '97/'98. I've called the phone service company to see if I could get any info from them and I never heard back.

Basically I'm not getting any more information from anyone. They are threatining me with a judgement uless I pay them.

I've researched both the attorney service and the phone service company on the BBB website and both have gotten bad reviews for false accusations and practice.

I could go on but I'll stop here.

You can sue them under the fair debt collections act and potentally receive damages. Be sure to log all times and content of the phone calls. Send the company a letter containing your experiences telling them to cease and desist all collections activities. If they continue, you should consider legal action-Martin
