Legal Question in Credit and Debt Law in California
Sandbagged by collector
Debt collector made phone demand for payment from my wife for a bounced check written by her ex husband 3 years after their divorce, and one year after the account was closed. Threatened if we didn't agree to pay before the end of the call, all three credit reporting agencies and checkfax would be notified or our default. Threatened sending the shariff to ''serve papers''. We refused as she has no liability for closed accounts after the divorce just because he kept some checks. They knew this, and did put report it. After he paid them, they want us to pay 45.00 to take it off. NO!! What are my remedies? I have written them a demand, enclosed proof of closeure date and divorce date, and copies of the CA codes they violated. I also made a complaint to the Attorney Generals office. I believe they knowingly defamed our credit and made illegal threats.
