Legal Question in Credit and Debt Law in California

Must they send you a statement?

My wife is paying a bill to a debt collector and they will not send her a statement what so ever. Is there some kind of law that says they must send her a statement of some kind. She has no idea what she has paid or what she still owes. Is there something that she can do or say to them to make them send her a statement? When she calls them for imformation they seem to get attitude very fast with her. They always are asking her is she is lying about how much she can pay, and return her calls sometime taking more then a week to call her back.

Thank you

Re: Must they send you a statement?

Yes, she should send them a confirming letter stating that this is the final payment and that by accepting the paymnet, cashing the check and not responding to the letter she will be paid in full. Otherwise, she will require a full accounting breaking down month by month the amount due, interest and penalties accrued and amounts paid. Should they keep trying to collect the debt, she should sue in small claims court for violation of the fair debt collection practices act and for a decision stating she owes nothing.
