Senior Citizen SS Ck only income- bank levy

My mom only gets SS check and Wells Fargo sent her a letter saying that they were ordered to take $6,000 out of her account. They couldnt since she only gets the check and there was no money. Her check should be coming thru now so what should I do? Contact Wells and tell them that its a ss check and not to release the funds? Any advice will be greatly appreciated.

I can only assume from the facts that your mother has a judgment against her. Be aware that no attorney can tell you how to "get around" any type of judgment, it would be a violation of our code of ethics.

With that being said, I am not certain, without performing research, if the Social Security payment is protected from judgments. Assuming that it is not, or that Wells Fargo will not take the time to recognize the difference in the deposits...I can tell you that an Abstract of Judgment has probably been submitted to any banking institution that your mother is CURRENTLY using and has an active account at. If her check is deposited into any of THOSE accounts, then it will be taken by the judgment creditor.

Your only legally proper option is to contact the judgment creditor and request a payment scheme be reached that meets with your mother's current financial ability.
