Legal Question in Credit and Debt Law in California

Small claims court - debt collection / cosigner

I cosigned for a friend for a department store credit card in order to buy a TV. We've recently had a falling out, and this person has stopped making payments. The account has gone delinquent and charged off. Yes, I am the cosigner and am responsible for the bill and have settled the account.

This person refuses to give me the television. My question is, do I have a valid case to take this person to small claims court in in order to get the television OR get back the money that I ended up paying to settle the account?

Thanks in advance.

Re: Small claims court - debt collection / cosigner

Yes. You won't get the TV back through a small claims court judgment, but you can get a judgment for your money. Whether you can collect is a different story. You were a good friend, for sure.
