Legal Question in Credit and Debt Law in California

Small Claims Court - ''Venue Table''

I am the Defendent, I Beleive the Plantiff incorrectly filled out the ''Plantiff's Claim and order to Defendent'' form. In uestion #4 our matter concerns a vehicle and it was filled in with a ''A'' when it clearly states that ''E'' is the proper letter to use. I also know for a fact that this person including our case has had three small claims during this calender year and it was marked that ''have not'' has more than two....

Our court date is today 7/17/03 please advise.

Thank you for your help.

Re: Small Claims Court - ''Venue Table''

You can move the court for a change of venue, and if you have documented evidence that the plaintiff has had more than two prior claims, you should make a motion to the court requiring plaintiff to post a bond as a "litigious party." That might end the case. Thereafter, just go to court and tell your story, I prsume you have a complete defense. You should come out a winner.
