on a small claims what happen when we don't know the person last name, do we file as a business which jesse plumbing or what thank you Frank

Just file it under the company name. Also, you can go to the County Recorders office to see if they have a fictitious name filing, which would show the owners name.

When anticipating someone who is doing business under a fictitious name, first check with the county clerk's office to see if he has filed a fictitious name certificate, if not, he cannot defend against your lawsuit, if he has, you will know who to sue. You can always file a suit against a John Doe, or Doe, and later amend when you find out who the person really is.
