Legal Question in Credit and Debt Law in California

Small Claims

Am I legally bound to a Retail Installment Contract if services were not rendered? Their collection is after me when they went out of business halfway throught the agreement. The service for Hair Restoration didn't work anyway.

Re: Small Claims

Only to the extent that services, as represented, were provided. However, the bigger problem is that the collection people won't necessarily honor that concept. You may be put in the position that you have to file a declaratory relief action to get the obligation absolved by the court. You could also raise it as a cross-complaint in a collection action against you provided that not too much time has passed by (i.e. presumably more than 4 years from the date their services stopped based on a written agreement).
