Legal Question in Credit and Debt Law in California

sent to small claims

I opened a credit account at a jewelery store, they asked for down payment, I told them i needed a few days then I would bring it in, they told me when I brought it in they would give me the merchandise. I decided I did not want it anymore and asked for them to cancel my account before any money and merchandise was exchanged. They are now sending me to small claims for not paying for merchandise I never took. Do I have a chance to get out of it even though I signed contract but nothing was exchanged, please help.

Re: sent to small claims

Read the contract you signed. It governs the rights and duties between you and the merchant. Good luck!
