Legal Question in Credit and Debt Law in California

Small Claims - Property Damage caused by a neighbor

My neighbor cut numerous branches off of 3 trees in our yard. All of the cuts were 1-3 feet across the property line on our property, and removed significant structure from them. The trees are severely damaged and may die. I have documented and photographed the damage. A police officer investigated the damage, and he stated how and where the neighbor cut my branches (over a fence 1-3 feet into my property) was illegal. I want to sue my neighbor to replace the trees. Do I have a strong and potentially successful lawsuit?

Thank you for your help,

Re: Small Claims - Property Damage caused by a neighbor

It does sound like you have a good potential lawsuit against your neighbor. Unless the value of the trees is over $5,000, it can be filed in small claims court.
