Legal Question in Credit and Debt Law in California

small cliams

Can the parents of an 19 year who is living at their home be held financially responsible for their son acts. The 19 old took our vechicle without our permission and had an accident. He caused $3800.00 in damage to our vechicle, we only had liability coverage on the vehicle. Can I sue the 19 year old and his parents in small claims court. I live in California and did not press charges because he was a neighbors son. But it was noted in police report that the 19 year old took car without our permission. Thank you

Re: small cliams

It appears that you can avoid liability for negligent entrustment of your vehicle, but not for the statutory liability of the owner of a vehicle involved in an accident. See the Motor Vehicle code (Sorry I cannot give you the section, the code is not presently available to me)
