Legal Question in Credit and Debt Law in California

SOL on escrow error

Due to an escrow error in 1995, my mortgage impound acct was credited incorrectly with a County tax refund, which was really owed to the excrow company. I was made aware of the error 3/30/2002 by the Escrow's Tax Service, who now wants to collect $1500, to correct the 6.5 year error. Has the SOL run?

Re: SOL on escrow error

If the escrow company can prove you knew of the error, but fraudulently did not disclose it, the Statute of Limitations begins to run when they actually, or when they reasonably should have, discovered the error, or your taking. You may not be "out of the woods" yet.
