Legal Question in Credit and Debt Law in California
Statue of Limitation
If charged with a crime in criminal court in 4/2004, but not arrested until 10/2004. What is the statue of limitation to file a civil case for the same crime? What if an insurance co received a claim to pay the victim in 12/2004 - what is their statue of limitation to sue?

Re: Statue of Limitation
What was the crime? A felony or a misdemeanor? When was the conviction? Those would affect the statute of limitations.

Re: Statue of Limitation
Usually, a victim can sue the criminal up to two years from the date of the crime, or one year after the criminal was convicted of a felony, whichever is later. A victim can also ask for a restitution order in the criminal case.
