statue of limitations

my husband is being harrassed by an x-girlfriend to repay money she gave him while they were living together. She is trying to obtain money for gifts she gave him as well as bills she paid while they were together. She is threatening to spead some presonal information to employers if he doesn't pay.

The statute of limitation for filing a lawsuit based upon an oral promise (assuming that there even was one) is 2 years. The limitation period for fraud or negligent misrepresentation is 3 years.

If she spreads private information to others, that could be considered an invasion of privacy. If the information she spreads is false, that could be considered defamation (slander). If he chooses, and depending on the sensitive nature of the private information and the type of job he's in, your husband might forewarn his employer that she's threatening revenge, thereby eliminating the shock value.

He could also change his phone number and/or e-mail address to avoid her.
