statue of limitations

I joined a health club in california and i called them and told them i was hurt and could not use there club anymore they never said anything about filling out any forms or anything now 7 years later they are taking me to court for failure to pay is any limit to how many years they can still make you pay

The statute of limitations for breach of contract is 4 years from the date of the breach. If the statute of limitations has passed, you may have a cause of action against the collection agency for violation of the fair debt collection act and maybe the fair credit reporting act. There is a 4 year statute of limitations on written contracts.

Have they actually filed a court action against you? If they have, and you win, you could possibly sue them afterward for abuse of process.
