Legal Question in Credit and Debt Law in California
Statute of limitations, and my credit report...
First question- My daughters father and I split four and a half years ago. When she was two, in 1997, we incurred some medical bills from an accident that she had. Her father recently filed bankruptcy, and included these bills on the discharge. Am I still financially responsible for the medical debts? If so, am I responsible for the entire amount? What is the statute of limitations for collections on this bill (this occured in Montana)
Second question- I understand the statute of limitations on written contracts is four years in CA. How long before this stuff starts coming off my credit report? If the statute of limitations is up, can I request to have the information removed from my credit report? Thank you for your time.

From a credit report standpoint, they may remain on your credit report for 7 years. If it is past that, you can have them removed.
The statute of limitations has expired in California, but I do not know what it is in Montana.
