Legal Question in Credit and Debt Law in California

Stimulus check

If I have a credit card judgement against me and I filed a joint return with spouse. Can they take our stimulus check? Shouldn't we be notified as well. Please advise.

Re: Stimulus check

They could obtain an ex parte writ of execution. This is a court order signed by the clerk which allows the Sheriff to notify the Federal Government that the court has ordered your funds be turned over to the sheriff so the sheriff can pay your creditor. Also, once that check is deposited in your or your wife's account, the account may be seized. You can hide your assets only so long. You may want to consider ways to get rid of this judgment.
