Legal Question in Credit and Debt Law in California

I was evicted from an apt. in Jan. of 2001. There were 3 people on the lease, I recieved a letter yesterday saying I am being sued for $4K+. I was the only one of the 3 on the lease to recieve this. I complied w/ the eviction so I don't know why this is coming up now. Is that legal? what are my rights? is there a time limit to this matter? please help. Thank you, Nicole

If the claim is based upon your written lease, he probably has several years to bring the action, the Statute of Limitations gives them four years to bring the action. You have to read your lease carefully to see what your undertakings were. What you agreed to. That will answer your question, regarding what you are liable for. You may also have a right to share any liability with your roomates. What did they agree to? Was there a sublease, or other written agreement. If unwritten, that may be barred by the Statute of Limitations. Enforceable only within one year of the cause arising.
