Legal Question in Credit and Debt Law in California

Can I sue for half of judgment

My ex and I have a joint judgment for a repossessed car for $2500. In court, we agreed with the creditor to each pay $50 per month. She keeps herself unemployed to avoid paying the bill. I pay my share faithfully. It was in our divorce judgment that each is responsible for 50% of the bill. I have paid more than my $1250. If I end up paying the entire $2500, can I then sue the ex in small claims for the $1250?

Re: Can I sue for half of judgment

The simple answer is yes. However, if your ex has no source of income and no other assets, even if you obtain a judgment, you may never collect what is owed to you.
