Legal Question in Credit and Debt Law in California

I want to sue someone who was living with me but moved out for 2 month past due rent and utilities. There was no written contract but of the three months she lived she paid once. Is that a confirmation to a verbal contract?

I agree with Attorney McCormick - file suit in small claims. You actually do not need the payment to prove a verbal contract; but without that one payment, it would be down to your word versus hers. With that payment having been made, it will bolster your argument that there was an oral contract for her to pay you rent each month. Good luck!
