i want to sue someone and take them to small claims court

i rented a car for my sister, she was not on the agreement. she drove the car, and she got into an accident. the damages were estimated out to about 7,200 dollars...for the simply fact that the car didnt have insurance coverage. i needed to know what do i have to do to file a claim and take her to court she said there was a police report and everything. This is going to go on my credit...how do i go about sueing her and taking her to a small claims court to have her take full coverage of the accident so it would not be on my credit. or pay the rental copy the amount owed. thank you for your time.

In addition to my colleague's thoughts, if you have auto insurance, you might contact your agent if your sister had your permission to drive the rental car. Perhaps your own insurance might cover the loss.

You can go to http://www.courtinfo.ca.gov/forms/, click on the drop-down box in the middle of the page and select "small claims" to fill out the forms needed. However, suing your sister is not going to prevent the rental car company from reporting the loss (or your liability for the loss) to the credit reporting companies.
