Legal Question in Credit and Debt Law in California
I'm being sued by Chase Bank USA, N.A. for $1,554.81. (credit card) It says I need to "file a proper legal form" within 30 days. Does that mean it has to be a court form?
Also, what do I write on it? (this is only my written response w/in 30 days)
My only income is from Social Security Disability. Does it matter that Chase negotiated payment arrangements 2 times in bad faith? (I have proof in writing) Each time they made arrangements with me (once from the executive office) & take my payment, then I'd receive a letter saying those arrangements weren't satisfactory. The original letter from the exec. office even says she'll have all add'l charges removed. After I paid, I received a letter where they renege again.

You will want to file an answer and have it served by mail. You can find the Answer--Contract form at http://www.courtinfo.ca.gov/forms/ . Make sure to assert appropriate affirmative defenses, or you will not be able to raise them at trial.
