Legal Question in Credit and Debt Law in California
I am being sued by a collection agency and have recently been layed off and am unemployed. I have less than $20 in my bank and am currently living off of cash aid. In 2 months when I get my income tax I will be claiming bankruptcy. I was going to claim bankruptcy before the court date but today I received a request for Entery of Default Clerk's Judgement. Will I still be able to take care if this with the bankruptcy if they make the judgement beforehand?

Sorry to hear about your financial hardship, why are you considering bankruptcy? If you don't have any assets, you need not fear having anything taken from you, or as the song goes, if you ain't got nothin, you've got nothin' to lose. While a bankruptcy might wipe-out your judgment, maybe it would be a good idea to talk to a bankruptcy attorney in person about your situation.
Yes you can file after a judgment is entered and discharge the debt. The judgment will remain but will be unenforceable.
