Legal Question in Credit and Debt Law in California

Being sued by a credit card company

Hello I received a letter today ''Notice of intention to incur court costs and legal fees by filing suit''

Further on it talks about if legal action is taken they are going to file a judgement against me and extent my obligation with court fees. I have tried to settle this debt before with letters by my last letter asking for a settled amount has never been replied to. Shall I get a lawyer now? Help. My debt is 4660 but now they are asking for interests. of 1 354 plus court fees. Please advice of how I should deal with this letter.

Re: Being sued by a credit card company

It depends how old the debt is. If it was not paid in more than 4 years, the statute of limitation bars collection. In that case, do not make any agreement to repay the debt. This is not a lawsuit, yet. They would have to file suit within 4 years of the debt, and you would have to lose for them to obtain a judgment.

There may be a violation of the Federal Fair Debt Collection Act. We would need to review the letter and any other correspondence you might have.
