Legal Question in Credit and Debt Law in California

Being sued for credit card default

I'm being sued for $3,700 by a law firm on behalf of a collections agency. I spoke with an individual from the firm today, trying to work out some types of payments. They want 75% of the debt as a down payment and monthly payments of $400-$500. This is far outside my ability to pay. I offered $600 dollars today and monthly payments in the $100-$200 range. I was told that anything less than 75% will result in them filing a suit. I am willing to pay, how do I prevent this going to court if I can not meet their current demands?

Odds are the lawsuit is completely bogus. When did you make the last payment? When was the last payment due? When were you served with the lawsuit? I handle many of these cases, usually successfully and for low fees.

One more thing. Don't talk to the CA or their law firm. Deal with them only in writing, preferably through your own lawyer.
