Legal Question in Credit and Debt Law in California
I am being sued by a debt collector for a Citibank credit card. I answered the summons with a general denial. The clerk said I had to send a stamped copy of the denial to the plaintiff. Is there a form I need to fill out to go with that? What is the timeline?

A person not a party to the lawsuit should complete a proof of service and mail a copy of it and the answer to plaintiff's attorney. The original signed proof of service should be filed with the court -- along with the answer, of course. You can find a form proof of service at http://www.courtinfo.ca.gov/forms/fillable/pos040.pdf .
You also should include affirmative defenses if you want this case to settle at a compromised amount. You have a second chance now to do it right. Contact me directly,.
