Legal Question in Credit and Debt Law in California

Being sued for a repossesed car

I purchased a truck but could not make the payments after a few months b/c I lost one of my jobs. I tried to exchange the truck for a smaller more affordable car to the dealership but they wouldn't help. I even contacted the loan company and they told me the dealership should be able to do that for me. Needless to say the car was repo, I explained to the collections company what had happed and I told them I could only pay a certain amount a month until I got another job and make larger payments. But they said it wasn't enough and wanted the entire amount. Now I am being sued for the entire amount. I don't know what to do. I don't have any extra money for a lawyer but I do need the best advice possible. Thank you for yor time.

Re: Being sued for a repossesed car

You say the car was repossessed.

They cannot have BOTH the car AND the "entire amount" of the loan.

If you are being sued, you need to file an answer very soon. I think you need to see a local attorney immediately. Note: I'm not local.

Good luck.

Re: Being sued for a repossesed car

You will probably lose. They will get a judgment against you. You will then have to either pay the judgment or they will try to garnish your wages or levy on your bank account.

You should read the Sacramento County Court Website at http://www.saccourt.com/ for more information, http://www.courtinfo.ca.gov/selfhelp for more information and my website at http://www.californiadebtblog.com for some information.

Good luck.
