Legal Question in Credit and Debt Law in California

I am being sued for a unpaid credit card. What form do I fill out to the court after I have been served?

It said I need to respond with a legal form, what form is that?

Thanks

If you feel the complaint has no legal defects, you file a form Answer, in which you can deny anything that you do not want to admit. If you ae liable and have no defenses, you should see if the matter can be settled.

A responsive pleading may be an ANSWER, DEMURRER, or MOTION TO STRIKE. While there is a form for an ANSWER, it is recommended to assert Affirmative Defenses so that every feasible issue is raised. An attorney can review the complaint to determine which response would best defend the suit. This office can draft an Answer with all Affirmative defenses or provide full representation so as to make it affordable for you. Contact me directly.

I agree with my colleagues, and you can also file a motion to quash if you believe the service was improper. If you want to file an answer use Judicial Council Form number PLD-C-010.

If you need help call your local county Bar association and see if they know the name of any free legal services or Legal Aid .

Good luck and hope this helps and remember to show up for court. If you keep showing up they are more likely to settle with you than if you just let it go.
